Londonderry Magistrate’s Court heard the alleged injured party told police she had been hit over the head and knocked unconscious by her ex-partner.

The incident was allegedly witnessed by their 12-year-old daughter who told officers her mother was hit over the head with a full bottle of wine.

However, the child wouldn’t provide a statement to police.

The court was told Smith was arrested and during police interview provided a prepared statement in which he denied the offences.

Opposing bail, the officer said police fear Smith would commit further offences as he has over 100 previous convictions and there is a 10 year domestic violence history with the alleged victim.

They also expressed concerns he would interfere with witnesses.

District Judge Barney McElholm refused bail, stating Smith is “obviously a violent, lawless individual.”

He added he had “absolutely no confidence” the 38-year-old would adhere to bail conditions.

Smith was remanded in custody and will appear in court again via videolink on September 6.
